PUBLIC NOTICE TO VOTERS IN THE TOWNSHIP OF 
HOLMDEL IN THE COUNTY OF MONMOUTH

This notice is published pursuant to N.J.S.A. 19:12-7. A Special Election will be held on Tuesday, July 26, 2022, between the hours of 6:00 AM and 8:00 PM.

 

THE DEADLINE TO REGISTER TO VOTE FOR THE SPECIAL ELECTION WAS TUESDAY, JULY 5, 2022.

 

VOTING REQUIREMENTS

To vote in Monmouth County, you must be a United States citizen, you will be 18 years of age by the next election, you will be a resident of the State and County 30 days before the election, and you are NOT currently serving a sentence of incarceration due to a conviction for an indictable offense under any federal or State laws. Registration deadline is 21 days before an election.

ATTENTION VOTERS WHO HAVE MOVED

If you are a registered voter in Monmouth County and have moved within the County, you should submit a change of address with the Commissioner of Registration, 300 Halls Mill Road, Freehold, NJ, 07728 phone #732-431-7780.

If you are a registered voter who has moved within the County, and you did not notify the County Commissioner of Registration of your new address, you will be permitted to vote at this election as follows: (1) Go to the polling place for the election district in which you reside on election day. (2) Tell the District Election Board Member that you are registered to vote but have moved within the County. (3) You will be permitted to vote by provisional ballot. You will need to provide your name, current and old addresses, date of birth and signature on the envelope provided with the ballot. You may call the Commissioner of Registration or your Municipal Clerk to determine your proper polling place location.

 

NOTE: HAVA (Help America Vote Act) REQUIREMENTS

First-time “Mail-in” registrants, voting in a Federal Election, MUST provide I.D. before voting.

 

Under New Jersey law you have the right to vote in privacy, to have a reasonable amount of time to vote, to receive a replacement ballot if you spoil the first one, and to bring written material into the polling place for your personal use.

A “Voter’s Bill of Rights” will be prominently displayed at your polling place. If you believe that your right to vote has been violated in any way, you should immediately notify your county Board of Elections or county Superintendent of Elections.

“Pursuant to provisions of the Voting Accessibility for the Elderly and Handicapped Act of 1984” (Public law 98-435), a telecommunication device for the deaf (TDD) is maintained at the Election Division, Department of State, Trenton, New Jersey.

PUBLIC QUESTION

Shall the COUNCIL-MANAGER PLAN of the Optional Municipal Charter Law, providing for FIVE (5) Council members to be ELECTED AT LARGE for STAGGERED terms at NON-PARTISAN elections held in NOVEMBER, with the MAYOR ELECTED DIRECTLY BY THE VOTERS, be adopted by the Township of Holmdel?"

EXPLANATORY STATEMENT TO ACCOMPANY THE PUBLIC QUESTION 

The voters of the Township of Holmdel will be asked at a special election on July 26, 2022 to approve a change of the Holmdel Township's form of government from the Township Committee form to the Council-Manager form (N.J.S.A. 40:69A-81, et seq.) under the Optional Municipal Charter Law, also known as the "Faulkner Act." 

If approved, the Township of Holmdel will be governed by a Council of five (5) members, which includes a directly-elected Mayor. The Council will exercise legislative powers and set municipal policy for the Township. The Council shall appoint a Municipal Manager, who will exercise all executive and administrative powers. The Municipal Manager shall serve at the will of the Council.

The Mayor will be directly elected by the voters for a term of four (4) years. The remainder of the Council members shall be elected by the voters for staggered terms of four (4) years each. In order to initiate staggered terms, three (3) of the first Council members elected under the new form of government shall serve for only two (2) years, to be determined by lot at the organization meeting of the first Council.

A municipal election shall be held every two (2) years thereafter.

The Council shall be elected at large through non-partisan regular municipal elections conducted under the "Uniform Non-partisan Elections Law" (N.J.S.A. 40:45-5, et seq.), and held on the day of the general election in November, rather than on the second Tuesday in May. 

Under the Council-Manager form, Holmdel residents will be allowed to place a new initiative on the ballot, or to approve or reject any ordinance passed by the Council, to be decided by voters in a process known as Initiative and Referendum.

If the change of government is approved by the voters at the special election, then the first municipal election will be held on November 8, 2022, and the new Mayor and Council members will be installed on January 1, 2023.

Monmouth County Board of Elections 

PUBLIC NOTICE TO ALL REGISTERED VOTERS 
IN HOLMDEL TOWNSHIP
IN THE COUNTY OF MONMOUTH

 

Pursuant to N.J.S.A. 19:12-9, you are hereby advised of the following procedure to be used for the Special Election to be held on July 26, 2022, from 6:00 a.m. to 8:00 p.m.

            

(1)  any person attempting to vote may be challenged by a candidate, by the duly authorized challenger for a candidate or a political party or on a public question, or by a member of the district board of elections, because the challenger or board member has good cause to believe  that the voter is not entitled to vote:

 

(2)  members of the district board and all duly authorized challengers are prohibited from challenging, delaying or preventing the right to vote of any person because of that person’s race, color, national origin, expected manner of casting a vote or residence in a particular housing complex or section of a municipality or county;

 

(3)  a person who is challenged may seek to establish his or her right to vote by swearing out and signing an affidavit attesting to the voter’s qualifications and/or providing a suitable identifying document for inspection, which may be--but is not limited to--the following; a valid New Jersey Driver’s License, a sample ballot with the voter’s name and address, an official Federal, State, County or Municipal document, a utility or telephone bill or tax or rent  receipt dated within 30 days or a piece of mail postmarked on or after the 60th day before the election; a copy of the affidavit shall be given to the challenged voter; the district board shall determine the validity of the challenge by voting on it pursuant to N.J.S.A. 19:15-24;

 

(4)  any challenger, who seeks to deny a voter the right to vote, must sign an affidavit stating the reason why the voter is not entitled to vote.  The district board will, when the challenge is made require the challenge affidavit to be signed by the challenger, the voter, and by the district board.  A copy of the completed form will be furnished to the voter;

 

(5)  any person who is denied the right to vote by reason of a successful challenge made at the polls may seek permission from the Superintendent of Elections to appear before a Superior Court Judge at Freehold to seek court order allowing that person to vote; the applicant should take copies of any affidavits given to him or to her at the polls and any proof submitted at the polls in support of that person’s right to vote;

 

(6)  forms to register complaints about the conduct of an election shall be available at each polling place in the county.

Voter Registration

To register to vote in you must be:

  • A United States citizen
  • 18 years old by the next election
  • A resident of the county for 30 days before the election

The registration deadline to vote at the next election is 21 days prior to election day.

Elections

Elections are held on the first Tuesday that follows a Monday in June and November. Polls open at 6 a.m. and close at 8 p.m.

For the year 2020 the Primary Election will be held on June 2, 2020 and the general election will be held on November 3, 2020.

Party Declaration

A registered voter desiring to affiliate with a party or change their party affiliation must file a political party affiliation declaration form 55 days before an election. The form is available at the Township Clerk’s Office or you may download a party declaration form (PDF).

Vote By Mail

In New Jersey, any voter can now vote via absentee ballot for any election. You do not need to state a reason for an absentee ballot. A completed application for vote by mail ballot may be sent to the Monmouth County Clerk up to 7 days prior to the election by mail or delivered in person at the Monmouth County Clerk’s Office until 3 p.m., the day before the election. The County Clerk cannot accept faxed copies of an application for vote by mail ballot. The forms are available at the Township Clerk’s office or you may download a mail-in form (PDF).
